Using personal bank cards for business revenue in China: what's the risk?

Routing business revenue — platform payouts, client payments, store cash — into personal bank cards outside the business's books and declarations is the single most common pattern in China's published concealed-income penalty decisions. Since Decree 810, the evidence chain assembles itself: platform-reported revenue on one side, minimal declared income on the other, personal-card flows in between.

Key terms: Golden Tax Phase IV refers to the fourth generation of China's tax administration infrastructure; Decree 810 refers to the Regulation on Internet Platform Enterprises' Reporting of Tax-Related Information (effective 2025-06-20); a "risk notice" refers to the letter a tax bureau sends asking you to self-check declared-versus-reported gaps.

Three typical forms

How the case gets built

The pattern in published decisions is consistent: platform data shows settlement revenue, the entity's declarations show far less, and the difference lands in personal accounts. Under Article 63 of the Tax Administration Law that supports a concealed-income (evasion) characterization: recovery of tax, a daily late-payment surcharge of 0.05%, and a fine of 50% to 5× the underpaid amount — with cooperative, proactive correction routinely landing at the low end.

If the history already exists

  1. Step 1 · Map it — every store, every payout path, every year, against what was declared;
  2. Step 2 · Quantify — three-scenario estimates of back tax, surcharge and fine ranges before talking to anyone;
  3. Step 3 · Correct proactively — amended filings and payment before a notice arrives is the lightest available path;
  4. Step 4 · Stop the pattern — all revenue into the business entity, personal cards out of operations.

Family and employee cards make it worse, not safer

Proxy cards add recipients to the exposure without changing the arithmetic. The comparison in published decisions: one operator, one gap, one fine — versus multiple account holders each explaining flows they cannot document. Simplicity is cheaper.

What operators ask in practice

Operators ask how far back exposure reaches — into every year the pattern ran, subject to limitation rules that depend on characterization. They ask whether small amounts matter — the published record includes four-figure fines; the floor is lower than people hope. And they ask whether switching accounts now helps — new patterns stop accruing, old ones remain; the remediation sequence (map, quantify, correct, restructure) prices better than any timing trick.

FAQ

Is it ever legitimate to receive business money personally?

Small, documented and declared — perhaps. Undeclared at scale — never. The test is whether the flow appears in declarations; if it cannot, the card is the problem.

What about money already spent?

Spending does not reset the calculation; the tax characteristic attaches to the undeclared receipt. Voluntary correction still prices better than discovery.
